YourPets Card Contest Official Rules and Terms and Conditions In consideration for the opportunity to have your card design considered by Hallmark Cards, Incorporated ("Hallmark") in the "YourPets" contest (the "Contest"), and by submitting your card design entry, you agree to the following: How to enter. All entries must be submitted online to: hallmark.com/you. Entries must consist of a photo in a high quality .pdf or .jpg format. Photos must be 300 dpi or higher; actual photo measurements should be around a 4" x 6" vertical photo or 1,200 x 1,800 pixels. Hallmark reserves the right to adjust, modify and crop the image. You must fill out the Official Contest Entry Form completing steps one through four. You can select from two options in this contest: Option A: Cropped image, copy on the front cover and copy on the inside of the card. Option B: Large image on the front cover only and copy on the inside. Official Entry Forms along with your photo and copy must be completely filled out to be eligible for judging. Entries without an agreement to the terms and conditions on the Official Entry Form will be disqualified without notice. Entries for the Contest must be received by Hallmark via the official contest website between 12:01 a.m. CST on January 14, 2008, and 11:59 p.m. CST on February 3, 2008. You may enter the Contest only once. Hallmark is not responsible for lost, stolen, illegible, misdirected or late submissions. Hallmark assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kind, delayed computer transmissions or network connection problems that are human or technical in nature. Eligibility. The Contest is open to all United States legal residents age 15 or older as of January 14, 2008, but not including employees of Hallmark and its subsidiaries and affiliates, their respective advertising and marketing agencies and their subsidiaries, affiliates, divisions and related companies and all children, spouses, siblings and parents of those employees, and employees of American Greetings or Recycled Paper Greetings. Judges will recuse themselves if familiar with any entrant. In the event of a dispute as to who has entered from a particular email address the registered owner of that email address shall be deemed to be the entrant. Entrants who are minors in their state of residence must have their parent's permission. Proof of parental consent will be required prior to a minor being named as an official finalist. Judging. A panel of judges, appointed by Hallmark, will select 67 Finalists. Entries will be judged on the following criteria: Sendability (30%); Appropriateness to Pet Theme (40%) and Humor and Cohesiveness of photo and caption (30%). At the judges' discretion, entries including unsuitable content, insufficient photo resolution, sexually explicit or inappropriate content, descriptions or images of animals in unsafe conditions, or content that is in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified. Hallmark retains sole discretion as to what constitutes unsuitable content and will not be liable in any way for disqualified entries. Entrants will not be notified if their entry is disqualified. Judges' decisions are final, binding and are not open to challenge. The Finalists will be posted on Hallmark.com/you on or about March 3, 2008 through September 14, 2008. (Potential Finalists will be notified by FedEx during the period February 15 to February 25, 2008, and must provide requested items as specified below in order to be named an official Finalist). Hallmark will allow visitors to Hallmark.com/you to place one vote per day for their favorite Finalist design, during a period from 12:01 a.m. CST on March 3, 2008, to 11:59 p.m. CDT on September 14, 2008. The Grand Prize Winner will be determined by the Finalist card design that receives the largest number of votes. In the case of a tie, the tying entries will be rejudged by a panel of judges selected by Hallmark. Each of the Finalist designs will be offered for sale to the public on Hallmark.com and at participating retailers from approximately June 16, 2008 through September 15, 2008. Grand Prize winner will be announced on or about September 19, 2008. Prizes. 67 Finalists: (1) Card design will be printed and available for sale on Hallmark.com and at participating retailers from approximately June, 16, 2008 through September 15, 2008; (2) $250 cash award; (3) A 10-pack of your printed cards and (4) remain eligible for the Grand Prize and Special Awards. Alternates: Alternates will be contacted in case any of the 67 Finalists are disqualified for any reason. An alternate will not be considered a finalist until further notified. Grand Prize Winner: (1) Card design will be available for sale on Hallmark.com for at least a year with the possibility of being offered for sale at retail as well, (2) An additional $1,000 cash award, and (3) a trip to Hallmark for you, a friend and your pet for a professional photo shoot and workshop with a designer and writer with the potential of the photo and writing being made into another card. Trip is worth approximately $4,000 and includes flight, transportation, a 2 night's hotel stay, and food. If the Grand Prize winner is a minor they must be accompanied by a parent or legal guardian. From time to time during the period March 3, 2008 to September 14, 2008, Sponsor may announce "special" or "category" voting contests for the Finalists only for prizes to be announced at those times. For instance, Sponsor may announce a four-week voting contest for the "cutest pet" photo. These Official Rules shall apply as to all matters except as specifically announced otherwise for a Special Award promotion, such as regarding specially announced judging criteria, voting deadlines, etc. Sponsor reserves the right to post special rules pertinent to such Special Awards, if any. Check the website from time to time to participate in these Special voting contests. Winners are responsible for all applicable taxes. Hallmark reserves the right to substitute the entire prize or any portion of it for a prize of equal or greater value. Warranties and Permissions. You grant, or warrant, that you are the creator and copyright owner of all content (graphics, illustrations, pictures and text) used in your design (the "Content") or that you have acquired all rights necessary (including without limitation any rights of animal's owner) and will produce these documents upon request to allow Hallmark to use the Content as described here and in the Contest, and that you grant to Hallmark a royalty-free, perpetual, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Rights that may exist in such Content. You also warrant and represent that you have obtained the written consent of any identifiable persons or the owners of any identifiable pets in the Content to use their likenesses in connection with this Contest. Minor finalists must have the consent of their parent or legal guardian, who must sign all documents and return as indicated above. You understand and acknowledge that Hallmark is in the business of designing and manufacturing greeting cards and therefore does not agree to treat your entry as secret or confidential. We hope you will understand that the intent of this policy is to avoid misunderstandings when projects developed by Hallmark's very productive staff are similar to someone else's creative work (and possibly yours). Accordingly, you release Hallmark from any and all claims, liability or causes of action arising from or related to the Content, and you will not be entitled to any compensation from Hallmark with respect to your entry or the Content other than as provided to winners of the Contest. You also release Hallmark, the Contest judges, Hallmark's advertising and marketing agencies and the officers, employees, consultants and advisors of both of them ("the Release Parties") from any and all claims of any nature arising from this contest, your entry, the Content and the use of the Content in any manner by any person. You give full consent to Hallmark (and parties deriving rights from Hallmark) to use the Content and your name, your likeness, home city and state (except where prohibited) in products and in all forms of advertising, promotional, editorial, marketing and collateral materials, specifically including but not limited to displaying your entry on Hallmark's Web site, Web sites operated by Hallmark marketing partners or any other third party, without additional compensation or permission, except where prohibited by law. You warrant that you have all necessary rights and permissions in the Content to allow Hallmark (and those deriving rights from Hallmark) to exercise the rights granted herein without infringing upon the rights of third parties. To be officially named as a Finalist, you will be required to provide proper identification, identification of the origin of elements of the Content, documents confirming your ownership of any rights and permissions necessary for Hallmark to exercise the rights granted herein, an affidavit of eligibility, a promotional release, and release from liability in favor of the Release Parties within three (3) days (72 hours) after receiving FedEx notification from Hallmark (scheduled for the period February 15 through February 25, 2008). In the event you do not supply the requested items within the time specified, you will not be an official Finalist and your entry will be disqualified without further notice Hallmark's decisions as to eligibility are final and not open to challenge. Hallmark reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or only the Internet portion, should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Hallmark's control corrupt the administration, security, fairness, integrity or proper administration of the Contest. In the event that Hallmark does not receive at least 67 qualified and eligible entries on or before February 3, 2008, Hallmark reserves the right to extend the entry deadline by up to 7 days, by notice given on this website. In the event of such an extension, judges will not discriminate between those entering prior to and after the original deadline, but Hallmark will not be required to produce any given card, regardless of ultimate finalist status. Void where prohibited or restricted by law. Subject to all federal, state and local laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of you, Hallmark and the Released Parties, shall be governed by and construed in accordance with the laws of Missouri without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of Missouri. By entering this contest, you agree to receive emails from Hallmark related to this and future contests, as well as other information from Hallmark.
